Introduction

Picoast is a mobile application developed and operated by Picoast LLC ("we," "our," "us", “Picoast AI”). By using Picoast, you agree to comply with these Terms of  Use, which outline the rules for engaging with our services responsibly and safely. Failure to follow these guidelines may result in suspension or termination of access to Picoast.

• Minimum age: You must be at least 13 years old or the minimum age required in your country to consent to use Picoast. If you are under 18 you must have your parent or legal guardian’s permission to use Picoast.
• Registration: To use Picoast, you are required to create an account and personalize your experience. You agree to provide accurate, complete, and up-to-date information when creating an account and using Picoast. You may not share your account credentials or make your account available to anyone else and are responsible for all activities that occur under your account. 

Picoast employs AI technology to generate content (Life Guru). We are continuously working on improving the quality and safety of the AI’s responses, but, as with any AI tool, the content generated may be inaccurate or not suitable for the user. A warning is provided within Life Guru and the user is urged to seek professional input for very important issues. By accepting these terms of use, you acknowledge and accept these risks, and agree that we are not making any representations or warranties to you that the content will meet your requirements or will help you achieve any particular results. Feedback is welcome through the app’s “Send feedback” feature. 

You must use Picoast in compliance with all applicable laws and regulations. Unauthorized or illegal use of Picoast is strictly prohibited, and any activity that violates the law may lead to suspension or termination of your account and notification of relevant authorities.

You may not use Picoast to generate, share, or request content that:

• Is hateful, discriminatory, or promotes violence, harassment, or abuse against any individual or group based on race, ethnicity, gender, sexual orientation, religion, disability, or any other characteristic.
• Contains graphic, violent, or sexually explicit material, including descriptions that may be shocking or inappropriate for the platform’s audience.
• Intends to mislead or spread misinformation that could harm others, including health-related or financial advice that lacks appropriate verification.

We reserve the right, in our sole discretion, to determine whether or not any content is appropriate and complies with these Terms of Use, as well as to refuse or remove any content. 

You must not attempt to access, retrieve, or disclose any information from other users or attempt to access areas of the app to which you have not been granted access. This includes:

• Any attempt to probe, scan, or test the security of Picoast or its servers.
• Attempting to bypass or disable any security features implemented within the app.
• Engaging in activities that could compromise the privacy or security of other users, including unauthorized access to their data or impersonating other individuals within the app.

When engaging with Picoast’s Life Guru or support staff, please ensure that your interactions are respectful and constructive. Inappropriate interactions, including offensive language, harassment, or attempts to misuse the AI for unethical purposes, are strictly prohibited.

You are prohibited from attempting to decompile, reverse-engineer, or extract any underlying code, algorithms, models, or other proprietary information from Picoast. Additionally, you may not use Picoast or its features to build, train, or inform any software, model, or product that competes with Picoast.

Automated use of Picoast, including through bots, scraping, or crawling, is not permitted. You may not use, or attempt to use, automated means to collect, store, or access any information from Picoast, nor use any automated methods to engage with the app’s content or services.

You must own or have obtained appropriate rights to any content that you input into Picoast. By submitting content, you confirm that you hold all necessary rights and permissions. You also agree not to input any third-party content unless you have prior consent from the relevant rightsholder.  All feedback provided by you to us regarding Picoast (or any part or function of Picoast) shall be our exclusive property, and you hereby assign all of your rights in any such feedback to us.

You may not use Picoast in any way that could impair its performance, interfere with other users, or place an unreasonable burden on the app’s infrastructure. Examples include:

• Excessive requests or interactions that disrupt or degrade the experience for other users.
• Attempts to manipulate or unfairly gain advantages in app features, including leaderboards or community engagement metrics.
• Any other action that could harm or disrupt Picoast, its users, or its reputation.

 Picoast may contain links to third-party websites that are not owned by us. We assume no responsibility for any third-party website or your use of any third-party website, including that we will not be liable in any way in connection with your use of or reliance on any content, goods or services available through any third-party website.   

•  Violations of these Terms of Use may result in the suspension or termination of your access to Picoast, with or without prior notice, and may include reporting to relevant authorities as required by law. We reserve the right to determine, in our sole discretion, whether any conduct violates the spirit or letter of these Terms of Use.
• By agreeing to these terms, you acknowledge that your use of Picoast is subject to these guidelines, and that any activity inconsistent with these Terms of  Use may result in immediate action, up to and including termination of your account.

To the maximum extent permitted by law, (1) our entire liability to you arising out of or relating to these Terms of Use or your use of Picoast shall be limited to the amount actually paid by you to us in the 12 months immediately preceding any claim brought by you, and (2) in no event shall we be liable for any special, incidental, indirect, punitive or consequential damages whatsoever (including, but not limited to, loss of profits, loss of revenue or loss of data), even if we have been advised of the possibility of such damages.

These Terms of Use shall be governed by and construed in accordance with the laws of Delaware. Any dispute arising out of or relating to these Terms of Use shall be resolved exclusively in the courts located in Delaware.

Picoast LLC reserves the right to modify or update these Terms of Use at any time. Your continued use of the Picoast app after any such changes constitutes your acceptance of the new Terms of Use. 

 Picoast LLC ("we," "our," "us", “Picoast”, “Picoast AI”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our app and services. By using Picoast, you agree to this Privacy Policy.

 We collect the following types of data from our users:

• Personal Data: To enhance your experience and enable personalized features, we collect the following information: (1) Required: First name, age, email, phone number, and life stage. (2) Optional: Location, birth date, pronouns, field of study or work, school or employer, and living situation.
• Device Information: We collect information about your device, including type (e.g., Apple or Android) and, possibly, IP address.
• Behavioral Data: We collect data on app usage, including interactions with features, frequency of use, and time spent within the app.
• Financial Data: If you use the budgeting tool, we collect information on your personal budget, income, expenses, and financial goals.
• Self-Assessment and Goal Data: Based on user inputs in self-assessment and goal-setting tools, we may collect data related to health goals, personality types, and other personal goals.
• AI Interactions: Conversations with our AI (Life Guru) are saved for future personalization, trend analysis, and feature enhancement.
• Sensitive Data: In using Picoast, you may choose to provide sensitive information. This includes, but is not limited to, your health goals, personality data, and other personal preferences. By providing sensitive information, you consent to its use for the purposes set out in this Privacy Policy.

• Primary Purpose: To provide you with access to your data in the app and to personalize AI interactions based on your inputs and profile.
• Analytics and App Improvement: We use anonymized behavioral data for internal analytics, allowing us to understand user behavior and improve our services.
• Future Personalization: We may use collected data to build more personalized AI models and for user benchmarking, such as feature use comparisons across users.

• Data Storage: All user data is stored securely on AWS servers. AWS complies with industry security standards (e.g., SOC 2, ISO 27001). 
• Security Measures: We implement commercially reasonable technical, administrative, and organizational measures designed to protect user data from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, no method of transmission over the Internet or email is completely secure or error-free. As a result, we encourage you to carefully consider the information you choose to share through Picoast. Additionally, we are not responsible for any circumvention of privacy settings, security measures, or protections implemented on Picoast or on third-party websites.
• Data Retention: We retain user data only for as long as necessary to fulfill the purposes for which it was collected. As we roll out the app and understand user usage, we will refine retention timelines for different data types.
• Data Breach Notification: In the event of a data breach involving sensitive information, such as financial or health data, we will notify affected users within 30 days if there is reason to believe their data was compromised.

• Account Management: Users may request a copy of their data or request deletion by emailing us at support@picoast.ai or via the app’s Send Feedback feature.
• Data Deletion Requests: Upon user request, we will delete all personal data associated with their account.
• Consent and Revocation: Users must accept our Terms of Use and Privacy Policy upon sign-up. While consent cannot be revoked, users may delete their data and discontinue use.
• Access and Correction: Users may update or correct current profile information, but historical data is not editable.

• Age Requirements: Picoast is intended for users aged 13 and older. Users confirm that they are 13 or older when signing up for Picoast. We do not knowingly collect data from users under 13. If we become aware of any data collected from users under this age, we will promptly delete it.
• Parental Consent: Users under 18 must have permission from their parent or guardian to use Picoast.
• Reporting Issues: If you have reason to believe that a child under 13 has provided Personal Data to Picoast LLC through the Picoast application, please email us at support@picoast.ai. We will investigate any notification and, if appropriate, delete the Personal Data from our systems. 

• Privacy Compliance: Picoast is not currently available in the EU, and we will update this policy to align with GDPR compliance if/when we expand to that region.
• Data Transfers: You provide personal information directly to our services in the United States. We may transfer personal information to affiliates, partners, and service providers in the U.S. and other jurisdictions. Please note that these jurisdictions may not offer the same level of data protection as the laws in your home country.

Picoast LLC reserves the right to modify or update this Privacy Policy at any time. Your continued use of the Picoast app after any such changes constitutes your acceptance of the new Privacy Policy.
