Introduction

LifeKick is a web application developed and operated by Picoast LLC ("we," "our," "us", “Picoast AI”). By using LifeKick, you agree to comply with these Terms of  Use, which outline the rules for engaging with our services responsibly and safely. Failure to follow these guidelines may result in suspension or termination of access to LifeKick.

• Minimum age: You must be at least 13 years old or the minimum age required in your country to consent to use LifeKick. If you are under 18 you must have your parent or legal guardian’s permission to use LifeKick.
• Registration: To use some features in LifeKick, you are required to create an account. You agree to provide accurate, complete, and up-to-date information when creating an account and using LifeKick. You may not share your account credentials or make your account available to anyone else and are responsible for all activities that occur under your account. 

You must use LifeKick in compliance with all applicable laws and regulations. Unauthorized or illegal use of LifeKick is strictly prohibited, and any activity that violates the law may lead to suspension or termination of your account and notification of relevant authorities.

You may not use LifeKick to generate, share, or request content that:

• Is hateful, discriminatory, or promotes violence, harassment, or abuse against any individual or group based on race, ethnicity, gender, sexual orientation, religion, disability, or any other characteristic.
• Contains graphic, violent, or sexually explicit material, including descriptions that may be shocking or inappropriate for the platform’s audience.
• Intends to mislead or spread misinformation that could harm others, including health-related or financial advice that lacks appropriate verification.

We reserve the right, in our sole discretion, to determine whether or not any content is appropriate and complies with these Terms of Use, as well as to refuse or remove any content. 

You must not attempt to access, retrieve, or disclose any information from other users or attempt to access areas of the app to which you have not been granted access. This includes:

• Any attempt to probe, scan, or test the security of LifeKick or its servers.
• Attempting to bypass or disable any security features implemented within the app.
• Engaging in activities that could compromise the privacy or security of other users, including unauthorized access to their data or impersonating other individuals within the app.

When engaging with Picoast LLC's support staff, please ensure that your interactions are respectful and constructive. Inappropriate interactions, including offensive language or harassment, are strictly prohibited.

Automated use of LifeKick, including through bots, scraping, or crawling, is not permitted. You may not use, or attempt to use, automated means to collect, store, or access any information from LifeKick, nor use any automated methods to engage with the app’s content or services.

You must own or have obtained appropriate rights to any content that you input into LifeKick. By submitting content, you confirm that you hold all necessary rights and permissions. You also agree not to input any third-party content unless you have prior consent from the relevant rightsholder.  All feedback provided by you to us regarding LifeKick (or any part or function of LifeKick) shall be our exclusive property, and you hereby assign all of your rights in any such feedback to us.

You may not use LifeKick in any way that could impair its performance, interfere with other users, or place an unreasonable burden on the app’s infrastructure. Examples include:

• Excessive requests or interactions that disrupt or degrade the experience for other users.
• Attempts to manipulate or unfairly gain advantages in app features, including leaderboards or community engagement metrics.
• Any other action that could harm or disrupt LifeKick, its users, or its reputation.

 LifeKick may contain links to third-party websites that are not owned by us. We assume no responsibility for any third-party website or your use of any third-party website, including that we will not be liable in any way in connection with your use of or reliance on any content, goods or services available through any third-party website.   

•  Violations of these Terms of Use may result in the suspension or termination of your access to LifeKick, with or without prior notice, and may include reporting to relevant authorities as required by law. We reserve the right to determine, in our sole discretion, whether any conduct violates the spirit or letter of these Terms of Use.
• By agreeing to these terms, you acknowledge that your use of LifeKick is subject to these guidelines, and that any activity inconsistent with these Terms of  Use may result in immediate action, up to and including termination of your account.

To the maximum extent permitted by law, (1) our entire liability to you arising out of or relating to these Terms of Use or your use of LifeKick shall be limited to the amount actually paid by you to us in the 12 months immediately preceding any claim brought by you, and (2) in no event shall we be liable for any special, incidental, indirect, punitive or consequential damages whatsoever (including, but not limited to, loss of profits, loss of revenue or loss of data), even if we have been advised of the possibility of such damages.

These Terms of Use shall be governed by and construed in accordance with the laws of Delaware. Any dispute arising out of or relating to these Terms of Use shall be resolved exclusively in the courts located in Delaware.

Picoast LLC reserves the right to modify or update these Terms of Use at any time. Your continued use of the LifeKick app after any such changes constitutes your acceptance of the new Terms of Use. 

Picoast LLC ("we," "our," "us", “Picoast”, “Picoast AI”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our app and services. By using LifeKick, you agree to this Privacy Policy.

 We collect the following types of data from our users:

• Personal Data: To enhance your experience and enable personalized features, we collect the following information: First name, age, email.
• Device Information: We collect information about your device, including type (e.g., Apple or Android) and, possibly, IP address.
• Behavioral Data: We may collect data on app usage, including interactions with features, frequency of use, friends relationships, and time spent within the app.
• Financial Data: If you choose to upload completion proof that contains personal financial information, we collect this information.
• Health Data: If you choose to upload completion proof that contains personal health information, we collect this information.
• Sensitive Data: In using LifeKick, you may choose to provide sensitive information. By providing sensitive information, you consent to its use for the purposes set out in this Privacy Policy.

• Primary Purpose: To provide you and your friends with access to your data in the app.
• Analytics and App Improvement: We may use anonymized behavioral data for internal analytics, allowing us to understand user behavior and improve our services.
• Future Personalization: We may use collected data to build more personalized experiences.

• Data Storage:  All user data is stored securely on Supabase servers, which operate on AWS infrastructure. Supabase complies with industry security standards including SOC 2 Type II and is ISO 27001 certified. User data is stored in secure databases with row-level security policies, and file uploads are stored in encrypted Supabase Storage buckets. 
• Security Measures:  We implement security measures through Supabase's enterprise-grade infrastructure, including end-to-end encryption, row-level security (RLS) policies that ensure users can only access their own data, secure authentication protocols, and automated backups. All data transmission is encrypted using TLS/SSL. However, no method of transmission over the Internet is completely secure. As a result, we encourage you to carefully consider the information you choose to share through Lifekick. Additionally, we are not responsible for any circumvention of privacy settings, security measures, or protections implemented in Lifekick or on third-party websites. 
• Data Retention: We retain user data only for as long as necessary to fulfill the purposes for which it was collected. As we roll out the app and understand user usage, we will refine retention timelines for different data types.
• Data Breach Notification: In the event of a data breach involving sensitive information, such as financial or health data, we will notify affected users within 30 days if there is reason to believe their data was compromised.

• Account Management: Users may request a copy of their data or request deletion by emailing us at support@picoast.ai or via the app’s Contact Us feature.
• Data Deletion Requests: Upon user request, we will delete all personal data associated with their account.
• Consent and Revocation: Users must accept our Terms of Use and Privacy Policy upon sign-up. While consent cannot be revoked, users may delete their data and discontinue use.
• Access and Correction: Users may update or correct current profile information, but historical data is not editable.

• Age Requirements: LifeKick is intended for users aged 13 and older. Users confirm that they are 13 or older when signing up for LifeKick. We do not knowingly collect data from users under 13. If we become aware of any data collected from users under this age, we will promptly delete it.
• Parental Consent: Users under 18 must have permission from their parent or guardian to use LifeKick.
• Reporting Issues: If you have reason to believe that a child under 13 has provided Personal Data to Picoast LLC through the LifeKick application, please email us at support@picoast.ai. We will investigate any notification and, if appropriate, delete the Personal Data from our systems. 

• Privacy Compliance:  We comply with applicable data protection laws, including the EU General Data Protection Regulation (GDPR). EU users have rights to access, correct, delete, and port their data. You can exercise these rights by contacting us. 
• Data Transfers: Your data is processed on Supabase infrastructure (AWS) with appropriate safeguards for international transfers. Data is retained only as long as necessary to provide our services. We process data based on your consent, legitimate interests for app functionality, and contract performance to deliver challenge tracking services.

For EU users, you can withdraw consent at any time and have the right to object to certain data processing activities.

Picoast LLC reserves the right to modify or update this Privacy Policy at any time. Your continued use of the LifeKick app after any such changes constitutes your acceptance of the new Privacy Policy.
